Terms of Service

Please read these terms carefully before using SmileBright.

SmileBrightis currently operated by its founder while company registration is being completed. These terms will be updated with the registered entity's details once incorporation is final. Paid plans are not yet enabled.

These Terms of Service (“Terms”) govern your access to and use of SmileBright(the “Service”), an AI-powered virtual receptionist that answers calls, books appointments, and routes enquiries on behalf of your business. The Service is operated by SmileBright (registration in progress) (“SmileBright”, “we”, “us”, or “our”). By creating an account or using the Service, you agree to these Terms.

1. Who can use the Service

You must be at least 18 years old and authorised to act on behalf of the business you register. You are responsible for keeping your account credentials secure and for all activity under your account.

2. The Service

SmileBright provides an AI receptionist that you configure with your business details, staff, services, and hours. The AI answers calls or web conversations from your customers and can create, reschedule, or cancel appointments and send notifications. You are responsible for the accuracy of the business information you provide.

The AI is an automated system. While we work to make it accurate and helpful, it may occasionally make mistakes, mishear a caller, or be unavailable due to factors outside our control (including third-party telephony, voice, and calendar providers). The Service is not a substitute for human judgement in urgent, medical, legal, or emergency situations, and you agree to configure appropriate emergency routing where relevant.

3. Free trial

New accounts include a limited free trial — a fixed number of demo calls — so you can test the Service before paying. Once the trial allowance is used, the AI will stop taking new bookings until you upgrade to a paid plan. The free trial does not require payment details.

4. Plans, fees, and payment

Paid plans are billed as recurring subscriptions (monthly, unless stated otherwise) plus any one-time setup fee shown at checkout. Prices are displayed in your local currency before you subscribe. By subscribing, you authorise us and our payment processor to charge the applicable fees to your chosen payment method on each renewal date until you cancel.

Cancellation, refunds, and what happens at the end of a billing period are described in our Refund & Cancellation Policy, which forms part of these Terms.

5. Acceptable use

You agree not to use the Service to:

  • break any law, or facilitate fraud, spam, or harassment;
  • impersonate another business or person, or misrepresent your identity;
  • place calls or messages to people without a lawful basis to contact them;
  • attempt to disrupt, overload, reverse-engineer, or gain unauthorised access to the Service;
  • resell or white-label the Service without our written permission.

We may suspend or terminate accounts that violate these Terms or that create risk or excessive cost (for example, abuse of free trials), with or without notice.

6. Your customers' data

When your customers interact with your AI receptionist, we process their information (such as name, phone number, and appointment details) on your behalf in order to provide the Service. You are responsible for having a lawful basis to collect and use that information and for complying with applicable privacy laws. Our handling of personal data is described in our Privacy Policy.

7. Third-party services

The Service relies on third-party providers for voice, telephony, calendar, messaging, and payments. Your use of the Service may also be subject to those providers' terms. We are not responsible for outages or changes in third-party services.

8. Availability

We aim to keep the Service available but do not guarantee uninterrupted operation. We may modify, suspend, or discontinue features, and we may perform maintenance that temporarily affects availability.

9. Disclaimers and limitation of liability

The Service is provided “as is” without warranties of any kind, to the maximum extent permitted by law. To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service is limited to the fees you paid us in the three months before the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost bookings.

10. Termination

You may stop using the Service and cancel at any time. We may terminate or suspend your access if you breach these Terms. On termination, your right to use the Service ends; sections that by their nature should survive (such as fees owed, disclaimers, and limitations of liability) will survive.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the “last updated” date above and, where appropriate, notify you. Continued use of the Service after changes take effect means you accept the revised Terms.

12. Governing law

These Terms are governed by the laws of India, and the courts at Hyderabad, Telangana shall have jurisdiction, except where applicable law requires otherwise.
